TERMS AND CONDITIONS OF MEMBERSHIP TO KOREATASTE.ORG

1. Purpose

a. The purpose of these Terms and Conditions is to provide for any and all matters necessary for the Korea Tourism Organization(hereafter the ’KTO’) to manage and operate Koreataste.org (hereafter the ‘Koreataste’), the KTO’s foreign language web page designed to promote Korean food and tourism in Korea.
b.The KTO shall provide all of Koreataste’s services to the users of the website upon the user’s consent to the Terms and Conditions and shall operate it in accordance with such governing conditions.
c. The details of this User Agreement may be updated from time to time and are subject to such changes without notice.

2. Definitions

  • ‘Users’ means any and all persons members and non-members, who obtain or use information from Koreataste.

3. Other Applicable Laws

  • a. The Terms and Conditions shall be subject to the Telecommunications Business Act, other applicable laws, and standard commercial practices in the Republic of Korea.

4. Application for Membership

  • a. Any individual that wishes to become a member of Koreataste shall fill out and submit application forms online.
    b. The KTO shall grant membership to individuals that fill out and submit the application forms except in the following cases:
    i) When the applicant submitted any false information or failed to submit required information, or when the KTO finds an individual to be unfit for membership in such cases as identity theft and termination of previous membership by KTO; and
    ii) When the Terms and Conditions have been breached.
    c. A member shall immediately make changes to a member’s profile at Koreataste when such changes occur. The members concerned shall be liable for any damages resulting from failure to make such changes.

5. Termination of Membership

a. Members may terminate their membership at any time by filing an application for termination. Membership termination shall take place immediately unless there are special circumstances.
b. In any of the following cases, the KTO may limit a member’s access to Koreataste or terminate membership:
i) When the member has disparaged a specific country, individual, or group or engages in any act that may cause diplomatic friction;
ii) When the member has submitted false information when applying for membership or changing the profile;
iii) When the member has violated any law or condition stated herein;
iv) When the member has made an unauthorized change to the information at Koreataste;
v) When the member has infringed upon the human rights or intellectual property rights of a third party and information held by Koreataste;
vi) When the member has illegally collected and used other members’ identity;
vii) When the member has disseminated sensitive information, text, or statistical data on other individuals or groups or violated generally accepted practices and common courtesy; and
viii) When the member has committed a criminal act. 

6. Personal Information Protection Policy

  • a. The KTO shall make every attempt to protect personal information of all members.
    b. The KTO shall not disclose personal information provided by the user to a third party without explicit consent from the user, except in the following cases:
    i) For the purpose of improving the service quality, or for the sake of statistical, academic or market research, but in a way that does not allow personal identification.
    ii) When relevant laws such as Act on Promotion of Information and Communications Network Utilization and Information Protection require providing personal information.

7. Use of Information

a. If any posting at Koreataste contains materials that violate Copyright Act and other relevant laws, the copyright holder may request the KTO to limit access to the posting or remove it in accordance with the processes prescribed in relevant laws. The KTO shall take actions as prescribed in relevant laws.
b. In such cases as below, the KTO reserves the right to remove any posting which may infringe a third party’s right or violate relevant laws or its policy: 
i) Defamation or denigration of a state, organization, company, or an individual; invasion of privacy; libel;
ii) When the content is in violation of public order or an offense against public moral;
iii) In case where it interferes or may interfere with providing the service; when the content violates any other rights including intellectual property rights;
iv) when the content is used for a commercial purpose such as promoting a specific product;
v) When the content undermines or is not relevant to furthering the purpose of the service;
vi) When the content is in breach of any other law or regulation.
c. The KTO is not responsible for the contents of the postings and made by the members of Koreataste, including the messages exchanged through the website and events that may arise from such activities.

8. Obligations of the KTO

  • a. KTO shall not engage in any act that may be in violation of laws or the Terms and Conditions, and shall provide continuing and reliable services under the Terms and Conditions.
    b. The KTO shall establish a security system to ensure safe enjoyment of the service by the members of Koreataste and and publicly issue a declaration of and comply with its privacy protection policies.

9. Obligations of Users

a. Users agree that they shall not engage in any of the following acts:
i) Providing false information when applying for membership or making changes to the member profile
ii) Making any unauthorized changes to the contents of Koreataste
iii) Infringing upon a third party’s human rights or intellectual property rights, or interruption with free or services provided by Koreataste
iv) unlawfully using other member’s identity
v) Disseminating information that disrupts public order or morals in any form including text and images
vi) Committing a criminal act
vii) Acts in violation of laws and the Terms and Conditions
viii) Acts of using and providing to a third party the information obtained from the service by means of photocopy, reproduction, modification, translation, publication, exhibition, or use in any other way without the KTO’s prior approval
b. The KTO may suspend or terminate a membership of any individual who has committed any of the acts set forth in Section a, and reserves the right to remove any contents and postings without notice in accordance with its policies and relevant laws.

10. Obligations of Members With Respect to IDs and Passwords

a. Members shall assume full responsibility for the security of their own IDs or passwords.
b. Individual or group members shall not delegate to a third party the right to use their IDs or passwords.
c. Members shall immediately notify the KTO of any breach of the security of or unauthorized use of their IDs or passwords, and shall fully comply with the security policies of the KTO.

11. Advertisement Policy

  • The KTO shall not be liable for any losses that result from an advertisement placed on Koreataste through an advertising agency by its member, because the commercial transaction concerns only the member and the agency.

12. Restrictions on Storage

a. Members agree that, with prior notice, the KTO may restrict the storage capacity, storage period, and other matters related to the My Page service.
b. Members agree that the KTO may suspend or remove the My Page service that has not been accessed for a certain period of time.

13. Authority and Liability Regarding Posted Matters

a. Users retain the rights (including copyrights) and responsibilities for the contents they post on the community bulletin board and blog. The KTO has the rights to use the contents without compensation for the purpose of providing the services at Koreataste.
b. The KTO objects to plagiarism of contents.
c. No member shall commercially use the information acquired through Koreataste’s service, including processing and selling the information; however, if any member wishes to use the information for a non-commercial purpose, such member shall obtain the consent of the KTO therewith.
d. The KTO shall protect postings from any unauthorized use.

14. Damages and Disclaimer

a. The KTO shall not be liable for any damage that is not prescribed by the privacy protection policies, with respect to free services.
b. The KTO shall not be responsible for failure to provide the Service, if it is unable to provide the Service due to a natural disaster, war and any other force majeure event equivalent thereto.
c. The KTO shall not be responsible for the damages resulting from using the Service. In addition, the KTO shall not be responsible for any loss that a member inflicts on another member.
d. The KTO shall be exempted from being held responsible for the damage caused by inevitable reasons such as repair, replacement, or regular checkup of or works on the facilities for the Service.
e. The KTO is not responsible for any of the contents collected by the Members.
f. The KTO is not responsible for the reliability and accuracy of the contents such as the information, data or facts that are posted by the Members.
g. The KTO is not responsible for any activities (including, but not limited to, data transmission and other community activities) between Members, between a Member and a third party or of Members, whether they are conducted within or outside of the scope of the Service.
h. If the user violates the terms and conditions set forth in this Agreeement and causes disruption to the service that may incur losses to the KTO, the user shall compensate the KTO for the losses.

15. Miscellaneous

The Terms and Conditions shall be construed and executed in accordance with the laws of the Republic of Korea. Execution of the Terms and Conditions shall be subject to the jurisdiction of a court in the Republic of Korea.

 The Terms and Conditions shall enter into force on JULY 1, 2010.
